TERM Text of Dt25-01:03--reference to convict is CAPPED
PEOPLE If there is a conflict between PEOPLE
and they go to court
and the righteous is vindicated
WICKED and the WICKED is convicted
WICKED If the WICKED is also liable to lashes
Then the Judge orders lashes
WICKED according to his WICKEDNESS
But no more than 40 lashes
BROTHER lest your BROTHER be humiliated*1

Hence the Rashi comment
