3 METHODS OF COURT BURDEN

VERY BRIEF SUMMARY

-  Dt01-12 Moses states: How can I bear your
-  BURDEN, BEARINGS and FIGHTS
There is no traditional way to uncover the meaning of
the Hebrew roots used in Dt01-12 For example the Hebrew root
Tet-Resh-Caph (BURDEN) only occurs 2 other times in the Bible.
Instead of using other verse references, Rashi infers meaning
based on his GENERAL KNOWLEDGE OF ATTRIBUTES of LAWSUITS.
Rashi, based on his knowledge of lawsuits identifies
3 areas of burden: a) to many witnesses; b) To many
counterarguments; c) To many lawsuits

BRIEF DESCRIPTION OF THE RULE and SUBRULE

There are many ways to find out the meaning of a word
- The simplest way is to LOOK IT UP IN A DICTIONARY
This works with KNOWN words

- If the word is not standard, still, there may be
many verses with similar usages. Hence we can
infer meaning FROM SIMILAR VERSES

- If there is no dictionary lookup
and no verse lookups
we might infer meaning BY OUR GENERAL KNOWLEDGE OF
AN AREA OF KNOWlEDGE.


STANDARD EXAMPLE

Dt20-03 states that in a war we should
- not be SOFT-HEARTED
- not be AFRAID
- not be ANXIOUS
- not be STUNNEd

There is no basis- in the dictionary or verses to relate these
items to more specific nuances. Rashi simply lists the 4
components of war
- FEAR OF TRANSPORTATION SUPERIORITY
- FEAR OF COMMUNICATION SUPERIORITY
- FEAR OF SUPERIOR MORALE
- FEAR OF SUPERIOR RESOURCES

The only way to justify this Rashi is to connect the 4 words
used with the 4 known aspects of war. Thus this is inference
based on EXPERTISE.

Rashi identifies the specific nuances of these words, not
thru other verses or the dictionary, but rather thru his
knowledge of court cases.

   Thus it is clear that the technique of REVIEWING SIMILAR
   verses does not shed light on the meaning of Tet-Resh-Caph

*2 Rashi gives the following example

   -If they saw Moses leave his house early they argued
   -that he was having marital problems.
   -If they saw Moses leave his house late they argued
   -he was plotting against people
   -But we neednt be so cynical.

   Simply--the whole idea of a law suit is that 2 people
   interpret the same action differently. Thus I might
   claim you owe me money because of a loan and you might
   counter that you perceived the loan as a payoff of a
   previous debt and not a new loan.

   For a verse with connections between the roots Nun-Shin-Aleph
   and R-Y-V see Gn13-06 but again this does not shed light
   on the meaning of the root
